Overview
This website, ondeloria.com (the “Site”), is operated by TCMV LLC, a limited liability company registered in the State of New Mexico, United States (Business ID 0008134806), trading as Ondeloria (“we”, “us”, “our”). We offer this Site, including all information, tools and services available from it, conditioned on your acceptance of the terms, conditions and policies set out here. By browsing the Site or buying from us you agree to be bound by these Terms of Service, together with the policies referred to in them: our Shipping Policy, our Return & Refund Policy and our Privacy Policy. If you do not agree to them, please do not use the Site. Our store is hosted on Shopify, which provides the ecommerce platform that allows us to sell to you.
1. Using the Site
By agreeing to these Terms you confirm that you are at least 18 years old, or that you are using the Site with the involvement of a parent or guardian. You may not use our products for any unlawful purpose, nor use the Site in a way that breaches any law that applies to you, including copyright law. You must not transmit any malware or destructive code. Any breach of these Terms will end your right to use the Site immediately.
2. General conditions
We may refuse service to anyone, at any time, for any lawful reason. You understand that your content, excluding payment card details, may travel unencrypted across networks; card details are always encrypted in transit. You agree not to copy, resell or exploit any part of the Site without our written permission.
3. Our products
We sell decorative lighting for the home: ceiling lights, pendant lights and chandeliers, wall lights, floor lamps, table lamps and outdoor lights. We describe each piece as accurately as we can, including its dimensions, finishes, light source and how it is fitted, and including its limits.
Many of our pieces combine hand-finished textures, glass, crystal, acrylic and wood. Textures, grain and the way glass catches the light differ slightly from piece to piece, and the light you receive may not be an exact match for the photograph. We have made every effort to show colours and finishes faithfully, but we cannot guarantee that your screen displays them accurately. These variations are a property of the material, not a fault, and dimensions are nominal and subject to small manufacturing tolerances.
Where a product page gives a light output, colour temperature, IP rating or battery life, it is the figure supplied by the manufacturer. How warm or bright a light feels depends on the room, the ceiling height and the colour of the walls.
Offers are valid while stocks last. Descriptions and prices may change at any time. We may limit the quantity of any product offered, and discontinue a product at any time.
4. Prices and payment
All prices are shown in pounds sterling (GBP). The price that applies to your order is the one displayed at checkout when you buy, and for a UK order it is the final price: delivery is free and there is nothing further to pay on delivery, no customs charge and no import duty.
Payment is taken securely at the time of order through our payment providers; we never see or store your full card number. Prices may change at any time, but a change will not affect an order we have already accepted.
5. Orders and acceptance
Your order is an offer to buy. A contract is formed only when we send you a dispatch confirmation. Please give current, complete and accurate billing and delivery information, and keep it up to date so that we can fulfil your order and contact you. We may decline or cancel an order before dispatch — for example if an item is out of stock, if a price was listed in error, if the order appears to come from a dealer or reseller, or if we suspect fraud. If we cancel an order after payment, we refund you in full without delay.
6. Delivery
Delivery areas, processing and transit times are set out in our Shipping Policy, which forms part of these Terms. UK delivery is free on every order; we dispatch within 1–2 working days and delivery then takes 5 to 7 working days (6 to 9 working days in total). Risk in the goods passes to you when you, or someone you have nominated, takes physical possession of them.
7. Returns and refunds
Returns are governed by our Return & Refund Policy, which forms part of these Terms. It gives you 30 days from delivery to return an unused, uninstalled light. That policy sits alongside, and does not replace, your statutory right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and your rights under the Consumer Rights Act 2015 to goods that are of satisfactory quality, fit for purpose and as described. Nothing in these Terms limits those rights.
8. Installation and electrical safety
Lights are electrical products, and fitting them correctly is what keeps them safe:
We are not responsible for loss, damage or injury arising from installation by someone who is not qualified to do it, from wiring that does not meet the regulations, or from using a product for anything other than its intended purpose. This section is general safety information, not electrical or legal advice.
9. Care
Switch a light off and let it cool before you clean it. Dust it with a soft, dry microfibre cloth — no solvents, no glass spray and nothing wet near the fitting. Handle glass, crystal and acrylic parts with care: they can break if dropped or knocked.
10. Accuracy of Site information
Occasionally the Site may contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, transit times or availability. We may correct errors and update or cancel orders affected by them, including after an order has been submitted, and we will tell you if we do. We are under no obligation to update information on the Site except as the law requires.
11. Third-party tools and links
The Site may include material from third parties or links to third-party sites that are not connected with us. We do not review or endorse their content and we are not liable for it. Please read their own terms and privacy policies before dealing with them.
12. Reviews and submissions
If you send us reviews, photographs of your lights in your home, ideas or other material, you agree that we may use, edit, copy, publish and distribute it without restriction or payment. We are not obliged to keep it confidential or to respond. Your submissions must not infringe anyone’s rights or contain unlawful, defamatory or obscene material, and you are responsible for their accuracy.
13. Intellectual property
The content of this Site — texts, photographs, graphics, logos and the Ondeloria name — belongs to us or our licensors and is protected by intellectual property law. It may not be reproduced, distributed or exploited, in whole or in part, without our prior written permission.
14. Liability
To the extent the law permits, we are not liable for indirect or consequential loss arising from your use of the Site or of a product, including lost profit or lost data, and our total liability for any claim will not exceed the amount you paid for the product concerned. We are not liable for injury or damage resulting from installation contrary to section 8, from use contrary to our care instructions, or from misuse of a product. Nothing in this clause excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded, and nothing in it affects your statutory rights as a consumer.
15. Severability and entire agreement
If any provision of these Terms is unlawful or unenforceable, it is severed and the remaining provisions continue to apply. Our failure to enforce a right is not a waiver of it. These Terms and the policies referred to in them are the whole agreement between us about your use of the Site.
16. Events outside our control
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including extreme weather, natural disaster, war, industrial action, government action, epidemic, or failure of a carrier, supplier or telecommunications network.
17. Governing law and disputes
These Terms are governed by English law, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the United Kingdom, you keep the benefit of any mandatory consumer protection where you live, and you may also bring proceedings in the courts of Scotland or Northern Ireland.
